    Mold and mildew can be a serious health hazard in homes. I represented a gentleman about 7 years ago who purchased a home in Sequim that was full of high levels of mold and mildew. He sued the seller for misrepresenting the condition of the home. While this kind of litigation is resulting in huge judgments in California and Texas and elsewhere, in Washington judges don’t know what standard to use to make their decisions, because no standard has been established.

    The Plaintiff purchased his home and moved in. He was a bachelor, but would have friends come over to play cards and his granddaughter would come to visit. Coughing, sneezing, runny noses and itchy eyes triggered questions by the Plaintiff until he decided to hire an expert from the Seattle area to take samples and get lab results. The expert’s testimony at court was that after 14 years of doing this kind of testing in Washington, this home rated in the 97th percentile of the most polluted homes in the State.

    The Sellers had made changes to the heating and circulation system that were not according to design and installation specifications. The crawl space acted as the plenum for the forced air, but the design called for a concrete floor, but the Sellers only used vis queen on the dirt ground. The mold built up throughout the house to very high levels, which would have required very expensive cleaning and replacement to make it inhabitable. The Sellers had not disclosed this to the Buyer and so it was misrepresentation and fraud.

    The judge granted judgment in favor of the Defendant Sellers based on his decision that every human being is different, and that there are no medical standards that define what is unacceptable or dangerous. After the judgment, the Seller had a problem: he had to sell the house and disclose the mold problem, but who would want to buy it then?

    If you’re buying an older home, or even a home that is only a few years old, due diligence in hiring the right professionals to put you on notice of health hazards is obviously very important. Wisdom would dictate that you have the right contingency language in your offer that gives you the right to have a professional inspect the house before you buy it. Does your real estate agent have the depth of knowledge and experience to protect you? I hope so.

    Land Sales 2007 in Sequim and Port Angeles

    Land sales in Sequim and Port Angeles for the calendar years 2006 and 2007 are represented in this graphic. The chart is fairly self explanatory. I’ve compared calendar year 2006 with 2007 in both Sequim and Port Angeles for the various lot sizes that have sold.
    The two noticeable decreases from 2006 to 2007 would be Sequim land sales for lots above 6 acres, which shows a drop of 23 lots sold in 2006 to 9 lots sold in 2007, and lots under 1 acre in size in Port Angeles, which shows 86 sales in 2006 and only 30 in 2007. Very interesting.

    From New Mexico to Sequim

    Over a year ago, during a visit to the Olympic Game Farm, we developed what we eventually called the “Sequim Syndrome.” We live in New Mexico and decided Sequim was where we wanted to live in retirement. On our second visit to Sequim, we met with Chuck and asked him to help us. Chuck's web site provides such amazing search capabilities. Chuck's site also contains a 1000 blog postings and a real estate video series detailing buying real estate in Sequim. We bought Chuck's book about Sequim real estate and set out to follow his advice carrying on an ongoing email and phone conversation with Chuck. Doing our due diligence “Marunde style” and using his MLS search site, we came up with about 50 homes that met our needs. We narrowed the list down to 15 properties that best met our needs.
